Privacy Statement

This app (hereinafter the “App“) is provided by  BASF plc, Earl Road, Cheadle Hulme, Cheshire, SK8 6QG, United Kingdom (hereinafter “us” or “we”). For further information regarding the provider of the App, please refer to our imprint.

 

A. Handling of personal data

In the following we wish to provide you with information on how we handle your personal data when you use our App. Unless otherwise indicated in the following chapters, the legal basis for the handling of your personal data results from the fact that such handling is required to make available the functionalities of the App as requested by you.

 

I. Use of functions of our App

 

1. Using our App

In order to make available to you the services of our App, it will transfer the following data to us, every time you use our App:

  • IP address
  • Device ID
  • Date and time of access
  • Time zone difference to Greenwich Mean Time (GMT)
  • Operating system and surface
  • Status of access/HTTP status code
  • Transferred volume of data
  • Language settings, version of app

To protect our legitimate interests, we will store such data for a limited period of time in order to be able to initiate a tracking of personal data in the event of actual or attempted unauthorized access to our servers.

Furthermore to provide you with the services of the app we also process the following data:

  • Image
  • GPS-location

We do also use Image data and GPS-location for any business purpose of BASF Group, such as the development, production and/or marketing of products or services (including but not limited to statistical purposes and to continuously improve both our image recognition algorithm in the field of digital farming and our App), but maintain the anonymity of each individual user so that the person cannot be identified.

 

2. Registration and login

You can use the App without being registered, but you have the opportunity to register yourself in the App for further services. For this registration and subsequent login procedure, we collect the following information about you:

  • Name
  • email address
  • Password

We process this personal data in order to provide you with additional information about the product and other products of Digital Farming, enable restoring information of your profile, to enable you to connect Scouting App to other Digital Farming products in the future and to enable in-app related profile saving, e.g. for ranks in gamification.

 

3. Access to your device’s interfaces

In order for our App to function properly, we need to access and use the following interfaces of your mobile device for the following purposes:

Interface Purpose
Camera To enable you to make photos of weeds which subsequently are sent to us for analyzes.
GPS Location Location To enable different services of the App and provide location specific content (e.g. radar functionality that provides you information of your surrounding area such as aggregated data of disease pictures taken). However, we only collect obfuscated geolocations from you, meaning that before your geolocation is sent to us, the last digits of your exact location are deleted. Once we send back information to you, your device then uses the exact location to pick out the information applicable to your exact location.

 

4. Online behavioral advertising

The App makes use of “adjust”, a service of adjust GmbH, Saarbruecker Straße 36, 10405 Berlin (“Adjust“). If you download the App in the context of certain marketing campaigns (e.g. you download the app after you have accessed the app store by clicking on a certain ad) Adjust will analyze your use of the App (e.g. how many pictures you have taken for weed analysis, what parts of the services have been used and how often). To this purpose next to the usage data the following data might be processed: IP address, MAC address, mobile identifiers depending on the device as iOS IDFA (Identifier for Advertising) and IDFV (Identifier for Vendor), Android ID or Google Advertising ID (if Google Play-Services have been activated on your device), Windows IDs. This data will be transmitted to a server of Adjust, where it will be stored and analyzed. The respective results will then be made available to us in anonymized form. We and our partner Adjust will use this information to better tailor our advertisements to you and your interests, to evaluate the efficiency of promotional campaigns, and to better comprehend the behavior of visitors after they have looked at a certain ad and downloaded our App.

By accepting this Privacy Statement you hereby agree to the aforementioned data processing for online behavioral advertising.

You may withdraw your consent to this type of analysis of your usage of the App at any time by either de-installing the App from your mobile device or you may visit https://www.adjust.com/opt-out/ select the device you wish to opt-out and provide your device identifier. 5. Information on side effects and quality complaints

This App is not intended or designed for communications regarding side effects, grey market products, incorrect or off-label use, quality complaints and/or other issues regarding the safeness or quality of BASF products.

If you nevertheless report to us undesirable side effects or other issues regarding the safeness or quality of BASF products, we will be legally bound to deal with your communication and may have to contact you for clarification purposes. Subsequently, we may have to notify the competent health authorities of the issues reported by you. In this context, your information will be forwarded in pseudonymized form, i.e. no information by which you may be directly identified will be passed on. We may also have to forward these pseudonymized notifications to our group companies and cooperation partners, to the extent these are likewise obliged to notify their respectively competent health authorities.

 

II. Transfer of data for commissioned processing

For the processing of your data we will to some extent use specialized service contractors. Such service contractors are carefully selected and regularly monitored by us. Based on respective data processing agreements, they will only process personal data upon our instruction and strictly in accordance with our directives.

 

B. Information regarding your rights

The following rights are in general available to you according to applicable data privacy laws:

  • Right of information about your personal data stored by us;
  • Right to request the correction, deletion or restricted processing of your personal data;
  • Right to object to a processing for reasons of our own legitimate interest, public interest, or profiling , unless we are able to proof that compelling, warranted reasons superseding your interests, rights and freedom exist, or that such processing is done for purposes of the assertion, exercise or defense of legal claims;
  • Right to data portability;
  • Right to file a complaint with a data protection authority;
  • You may at any time with future effect revoke your consent to the collection, processing and use of your personal data. For further information please refer to the chapters above describing the processing of data based on your consent.
